Jarryd Hayne settles in US civil law suit over alleged San Jose rape
Former rugby league star Jarryd Hayne has reached a settlement with his alleged victim in his United States rape case.
After months of negotiations between the parties, the civil suit has been brought to a conclusion.
The young American woman, identified only as JV, had accused Hayne of sexually assaulting her in San Jose in 2015 during his NFL stint with the San Francisco 49ers.
Authorities did not have sufficient evidence to lay criminal charges over the alleged incident, prompting JV to file a civil suit in December 2017, claiming damages resulting from sexual battery.
Documents filed in the San Jose Division of the US District Court Northern District of California, seen by The Sydney Morning Herald, include a "Notice of voluntary dismissal with prejudice," executed by legal representatives for both Hayne and JV, outlining the agreement to end the proceedings.
Plaintiff, J.V., gives notices that all claims, causes of action, counterclaims and defenses that the parties have or may have had in this action have been resolved and are hereby voluntarily dismissed with prejudice," says the notice, which was filed and executed on Wednesday.
It adds that "each party shall bear their own attorneys’ fees and costs."
According to court papers, JV was at a bar with friends in San Jose, California, after attending a football game between the 49ers and the Cincinnati Bengals in the afternoon, where she met with Hayne and his friends.
She alleged the pair then travelled in an Uber back to Haynes’ apartment where he raped her, resulting in vaginal bleeding.
The papers state the woman had no recollection of how she entered Hayne's home, and only remembered "seeing a silhouette of a man with [Hayne's] build coming towards her," before the alleged rape.
The action also included claims of gender violence, infliction of emotional distress and negligence.
The prospect of a settlement was flagged in May when the alleged victim’s legal team told US District Court Judge Lucy Koh that "the parties are currently in settlement talks and may be close to achieving a resolution of the entire matter". The matter had been set down for a trial in January next year.
On Thursday, JV's lawyer in Oakland, California, Micha Star Liberty, confirmed the settlement with Hayne but declined to comment further.
In a tweet, however, Ms Liberty said "It was an honor to represent JV in this matter. May her fortitude and strength be an inspiration to all survivors."
Ms Liberty has previously told the Herald JV's faith was front and centre in the consideration of general damages claimed, which aimed to quantify the "pain and suffering" she allegedly experienced.
Hayne is living in Perth, where he is undergoing "disciple training" at evangelical Christian youth ministry Youth With a Mission.

No way will Hayne get jail time. Money can buy your way out, unless you're a serial predator with a long list of victims.

Wasn't he the devil and he blamed violent pornography for him being the way he was. LOL Talk about excuses. Hayne messed up twice and the Newcastle girl was someone he should of stayed away from. She was known to Police. I'll give him the benefit of the doubt on that one, but he still made a mistake with the assault. Unless numerous girls come forward and claim their muff was bitten, I wouldn't really call Hayne a repeat offender. He just made silly mistakes.

I would classify a repeat offender as someone that does something more than once, therefore the Phantom would be classified as a repeat offender. What sort of record does that girl in Newcastle have with the cops anyway? I know nothing about that?

Put it this way, I don't think nice girls are going to agree to a one night stand, after just meeting on-line. Although Hayne is probably not good enough for a woman with class. OK, they're both bad!!

you have to worry about diseases with someone who agrees to a one night stand on the internet. How loose of a woman is that? Then agains the Phantom is quite famous, so that probably works in his favor. He isnt to famous in Perth. I wonder what the monks think of him? I wonder if they think he is for real or doing it to get off a criminal offense?

The details of the settlement remain confidential after the parties struck an agreement last week after months of negotiations. However, The Sun-Herald can reveal the former Eels, Titans and 49ers star paid a high five-figure sum to resolve the civil lawsuit.
Authorities did not have sufficient evidence to lay criminal charges over the alleged incident, prompting the woman, identified only as JV, to file a civil suit in December 2017. She had accused Hayne of sexually assaulting her in San Jose in 2015 during his NFL stint with San Francisco and claimed damages resulting from sexual battery. Hayne was allowed to continue his NRL career with Parramatta in 2018 after the allegations surfaced, although he hasn’t played professional football since that one-year deal expired.

JV claimed she was intoxicated at the time of the alleged incident and was a Christian who was saving herself for marriage. Hayne is also a Christian and is currently living in Perth, where is is undergoing "disciple training" at evangelical Christian youth ministry Youth With a Mission.
Hayne has listed his Darlinghurst investment property for sale at an asking price of $2.275 million, $75,000 lower than when it originally came onto the market in July.
The NRL has moved to improve off-field behaviour via the introduction of its "no fault" stand-down policy after a spate of off-field incidents last off-season. The new protocols were brought in after there were 66 separate allegations of players behaving badly in the space of just four years.

it will take longer but since he is in Perth he should take the slow fishing boat to New Guinea from there. Nobody at all will notice it as he is a nobody there. Long Bay Phantom Monk, love it.
